GENERAL TERMS AND CONDITIONS (GTC)

 

1. Scope of Application

These General Terms and Conditions apply to all workshops, custom orders, gift vouchers, and purchases made through the webshop available via the website jkaldy.ch.

 

2. Workshops – Registration, Payment, Cancellation

In the case of time-specific services, no right of withdrawal without cause shall apply where the service relates to a specific date or period, in accordance with the provisions of Swiss contract law (Swiss Code of Obligations, CO, Art. 40a).

Registration for a workshop constitutes a binding contract upon confirmation of the registration.

 

Cancellation Conditions

Participants are entitled to cancel their participation in a workshop under the following conditions:

If cancellation is made no later than the 5th calendar day prior to the scheduled workshop date, the participation fee will be refunded in full or may be rebooked for an alternative date.

 

If cancellation is made no later than the 3rd calendar day prior to the workshop date, 50% of the participation fee shall be payable.

 

In the event of cancellation within 3 calendar days prior to the workshop date, or in the event of non-attendance, the participation fee shall not be refunded.

 

The participation fee includes the cost of basic materials (sterling silver 925) and the use of tools provided during the workshop. The use of other materials (e.g. gold alloys) is possible only by prior individual agreement.

 

Liability

Participation in the workshop is at the participant’s own risk.

Materials and tools are used under the guidance and supervision of the instructor; however, the service provider assumes no liability for damage caused by or suffered by the participant during the workshop, unless such damage is attributable to culpable conduct on the part of the service provider.

Jewellery items personally created by the participant during the workshop do not qualify as commercially marketed products. Accordingly, neither warranties nor statutory warranty rights apply, in accordance with the relevant product-related provisions of the Swiss Code of Obligations (CO)."

3. Webshop, Shipping and Returns

Products in stock are dispatched within 2–3 business days.

For custom-made or personalised products, fulfilment is carried out based on individual prior agreement.

 

Collection and Delivery Options:

Personal collection in Liestal at a pre-arranged appointment (free of charge).

Home delivery: within Switzerland via Swiss Post.

The shipping fee is CHF 8.50.

 

All prices are stated in Swiss francs (CHF) and do not include value added tax (VAT). j.Káldy, as a sole proprietorship, is exempt from VAT.

 

Right of Withdrawal:

Customers are entitled to a 14-day right of withdrawal for intact and unused products. In the event of a return, the consumer shall bear the direct costs of returning the goods. The goods must be returned to the seller’s address.

Custom-made or personalised products are excluded from the right of withdrawal and cannot be returned.

 

For deliveries to the European Union, any applicable customs duties and import taxes shall be borne by the customer.

Gift vouchers are valid for one (1) year, are transferable, and cannot be redeemed for cash.

 

Payment Methods:

Credit card payment: via the Stripe payment system. After entering the required credit card details and clicking the “Pay” button, the payment will be processed. Upon successful payment, the system sends a confirmation and redirects the customer back to the webshop, where a further payment confirmation is provided. If the credit card payment is declined by CIB Bank for any reason, the customer may also complete the payment via the link included in the confirmation email.

 

Bank transfer and TWINT: The purchase price may also be settled by bank transfer or via TWINT. The transfer is initiated by the customer through their own banking institution. The information required for bank transfer and TWINT payment will be sent to the provided email address after the order has been submitted.

 

Cash payment: available for personal collection in Liestal at a pre-arranged appointment."

4. Warranty

 

Statutory Warranty (Implied Warranty of Conformity)

Pursuant to the Swiss Code of Obligations (CO), the service provider warrants that the delivered products comply with the contractual agreement and are free from defects that significantly impair their value or suitability for their intended use.

Consumers are entitled by law to a statutory warranty period of two (2) years from the date of delivery of the product (CO Art. 210).

In the case of consumer sales, the law presumes that any defect discovered within the warranty period already existed at the time of delivery, unless such presumption is incompatible with the nature of the defect or the characteristics of the product (CO Art. 210 para. 3).

 

Scope of Warranty Claims

In the event of a justified warranty claim, the buyer is entitled, within the limits of the law, primarily to request:

repair of the product, or

 

replacement of the product, provided that this is reasonable and feasible.

 

If repair or replacement is not possible or would entail disproportionate additional costs, the buyer may:

request an appropriate reduction of the purchase price, or

 

withdraw from the contract in the case of a material defect

(CO Art. 205–208).

 

Special Provisions for Custom-Made Jewellery

In the case of jewellery produced on an individual order (in particular items made to specific sizes, with engravings, names, dates, photo engravings, or based on a custom design), replacement shall be possible only if the defect is clearly attributable to the seller.

 

The following circumstances do not constitute defects and do not give rise to warranty claims:

changes resulting from the natural properties of the material (e.g. scratches, development of patina, wear),

 

damage resulting from improper or non-intended use (e.g. impact, contact with chemicals, use during sporting activities).

 

Right of Withdrawal for Custom Products

The parties expressly agree that, in the case of custom-made products, the buyer is not entitled to a right of withdrawal without cause, as such products are manufactured according to the buyer’s individual specifications (CO Art. 40a)."

5. Jurisdiction and Venue

If the consumer identifies an infringement of their rights under the Swiss Code of Obligations (CO), they are entitled to submit their complaint primarily directly to the seller.

The consumer is entitled to refer the matter to the conciliation authority competent at their place of residence or at the seller’s registered office, or, as a final step, to assert their claims before the competent civil court.

The place of jurisdiction for any disputes shall be Liestal, Basel-Landschaft, Switzerland."

5. Purpose of Data Processing

Personal data are processed for the following purposes:

processing of orders, bookings, and enquiries,

organisation and delivery of workshops,

handling of invoicing and payments,

customer service, including warranty and complaint handling,

compliance with statutory and regulatory obligations.

 

No automated decision-making or profiling is carried out.

The principles of data protection (privacy by design, privacy by default) are embedded in our operational processes.

In the event of a data breach, affected individuals as well as the Swiss Federal Data Protection and Information Commissioner will be notified without undue delay in accordance with applicable legal requirements.

 

6. Website Registration

Registration is a convenience feature and is not mandatory.

The webshop may also be used as a guest without creating an account."

7. Legal Basis for Data Processing and Data Retention

The legal basis for the processing of personal data is:

the consent of the data subject,

the performance of a contract,

the fulfilment of legal obligations.

 

Financial and invoicing data are retained for a period of ten (10) years in accordance with applicable Swiss legislation, in particular the Swiss Code of Obligations (CO).

 

8. International Data Transfers and Data Processors

Personal data are disclosed to third parties only to the extent necessary for the performance of a contract, the fulfilment of statutory obligations, or the operation of the website (e.g. shipping providers, payment service providers, or hosting providers).

Please be informed that our website is operated on the UNAS webshop platform, which is operated by a company registered in Hungary and whose servers are located within the territory of the European Union (Hungary). UNAS processes personal data as a data processor solely on the instructions of the controller.
